Dem lawmakers say courts should
resolve debt-limit standoff

The Hill (DC), by Alexander Bolton

Original Article

Posted By:StormCnter, 1/8/2013 6:04:15 AM

Democratic lawmakers are urging President Obama to force Republicans to take him to court over the controversial issue of raising the debt ceiling. They believe the Supreme Court will have to ultimately resolve the battle over spending now raging between Republicans and the president. But how the courts will rule is shrouded in uncertainty because little case law exists to serve as meaningful precedent, say legal scholars. Democrats in Congress argue Obama should not feel constrained by the 1917 debt limit law, which the federal government is projected to hit in late February, because it conflicts with other laws.

This 14th Amendment argument is one of the dummest things the DIMs have come up with yet. It´s like saying I can´t make my mortgage payment to the bank this month because my Cable TV bill + combined cell phone bill is so high.

All this stuff is crystal clear in bankruptcy court. It is called Senior Debt and Subordinated Debt. Some gets paid, some doesn´t.

The Dems are the party of the stupid people. Really disgusting to be anywhere near them.

When the liberals don´t like the rules, they change the rules.Digging up obscure liberal scholars to make their case, isn´t a basis for a valid argument.Borrowing 40 cents out of every dollar we spend isn´t good enough for the left. This country has spent something in the range of 19% of GDP for decades,so there wasn´t any outlandish spikes in spending vs. the revenue and growth side. It´s now spending around 25% of GDP which is an enormous leap.

The liberals are in 100% denial that amassing huge debt is a problem. We have an anemic 1.5-2% growth rate despite spending all this money so how can the left say the spending is helping the economy.

The other unfathomable side of this is Obama killing jobs which lessen revenues putting more pressure on borrowing. Obama firmly rejected the idea that you can grow out of a deficit problem. To him, central planning is the silver bullet and he needs trillions more to pull this off.

The 14th amendment clearly does not apply to the debt ceiling. It concerns debt that has already been issued rather than issuance of further debt. If Obama wants to play this game he should issue the trillion dollar platinum coin (a "Geithner").

Add to #1, the bigger lie is that raising the Debt Ceiling is only to fund future NEW debt. Meaning that "we can´t cut our Cable TV subscription for next year ..."

14th Amendment for aftermath of the Civil War, that the cost for 1861-1865 was not to be denied by any southern legislators "Wasn´t my War". It happened, and it was all in the Rear View Mirror. Past Debts.

The courts have no authority over the budget, spending or borrowing. Their function is to rule on the law, and the law clearly states, in so many words, that CONGRESS, determines how the money is raised and spent.

OK class, one more time. The so called President and the Senate have no real say so over the budget. All spending bills originate in the house and they and they alone tell the pres and the senate how much is available. That is unless you have bonehead involved in which case the other guy wins. That being said, both sides ignore the law.
And we let them, shame on us.

Proponents of the Affordable Care Act (ACA) insist that the law will extend health insurance to millions, expand access to health care, and improve Americans’ overall health. But, as the New York Times recently reported, at least 20 percent of the new enrollees have not paid their premiums. They therefore do not really have insurance. But even for those enrollees paying premiums, having health insurance is not the same thing as getting good health care, or any health care. In fact, it doesn’t matter how many Americans obtain insurance under the ACA. Most will have difficulty finding a physician. Many Americans

A few years ago, the corruption convictions of several prominent plaintiffs´ lawyers put a spotlight on dishonesty in American civil courts. Now the sleaze has burst back into the news with cases involving Chevron and Dole Food Co., this time with an international twist. Last month, a federal court in Manhattan found that a U.S. plaintiffs´ lawyer had masterminded a multibillion dollar fraud and extortion scheme against Chevron in Ecuador. Three days later, a California appellate court affirmed the dismissal of a lawsuit against Dole as a "fraud on the court" perpetrated by U.S. and Nicaraguan plaintiffs´ lawyers.
