Long before Erika Menendez was charged with pushing a stranger to his death under an oncoming train at a Queens elevated station, she had years of contact with New York City’s mental health and law enforcement establishments. She was treated by the psychiatric staffs of at least two city hospitals, and caseworkers visited her family home in Queens to provide further help. She was also arrested at least three times, according to the police, twice after violent confrontations.

What is wrong with this state that they do not put these people away permantly. I have two granddaughters that work in an asylum and they are physically attacked often and needless to say, help is hard to hire and they do not stay long. It is a problem that needs to be solved as soon as possible.

#4, the problem is very simple. In the 1960´s and 1970´s, governments got the bright idea that they could save money on mental health treatment by closing state facilities and replacing them with community-based oversight of the severely mentally ill. Except...they didn´t bother to fund the community-based programs. They simply ´saved´ money by closing the state institutions. Then they turned around and spent that ´saved´ money on increasing the prison system - after all, politicians wanted to be ´tough on crime!´ So now we only house severely mentally ill people in institutions after they commit a crime! (Oops, too bad for the victims of those crimes...but that is the new ´gateway´ to a bed plus 3 meals.)

Yes, this woman killed without using a gun. However, would you want this woman to have unlimited 2nd amendment rights to a gun? Or should there be some regulations that could keep people like this woman from purchasing a weapon? Given her track record, certainly her family and the medical professionals could have certified that she was a risk...but of course, they could not have her hospitalized until that risk was ´imminent´ - a standard that all too often only comes into bear after a crime has been committed.

If we are not going to reopen state hospitals, I suggest we bring back exorcisms--because these murderous people are evil as well as insane. Why don´t they express their mental illness by passing out flowers instead of shooting school children? Why didn´t Ms. Menendez stick around the subway station instead of hightailing it, if she had no concept of right or wrong or crime and consequences. What´s really insane is letting these people prompted by their evil demons on the streets to molest passersby and murder the innocent.

Under 18 U.S.C. § 922(d), it is unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person “has been adjudicated as a mental defective or has been committed to any mental institution."

Under NY penal law 400.00, no person shall be issued a license to carry, possess or dispose of a firearm unless he or she has stated whether he or she has ever suffered from any mental illness or been confined to any hospital or institution, public or private, for mental illness.

I think we pretty much agree that there are laws in place to keep her from getting a gun, and no one is proposing relaxing these laws.

we can thank the ACLU and the clintons for this...ACLU sued saying the civil liberties of the people in mental hospitals were being violated and these peope were being held against their will and the clinton adminstration agreed...needed more votes...
There are background checks for people and if the paper work is done properly this women would NOT be able to purchase a gun...

But just see how she used the subway train as a tool in stead of a gun...so we must ban subways...its the only way to correct this problem....

Has anyone on this thread stated that she should have had rights to a gun? There are a numerous laws on the book, one referenced above, to keep mentally ill people from getting guns. The point here is that mentally ill people (and evil, bad guys in general) usually commit crimes regardless of whether or not they can get their hands on a gun. Look at what just happened in India -- 6 Indian men raped a woman, ultimately killing her, and, as far as we know (from media reports), there was not a gun in sight.

The issues of dealing with the mentally ill goes back a lot further than the Clinton era. All he ever did was to inject steroids to several existing programs (housing for ex.) and then stand back to avoid the blowback results. The ACLU has been ruining things in this country since the 60´s.

These regulations already exist. They are called ´Background Checks.´ It´s what everyone legally purchasing a weapon from a dealer or gun store has to go through.

I know, listening to the media, that one would be lead to believe that buying guns is like buying cabbage…just pile up your cart and check out. But it really doesn´t work that way! Hasn´t in a long, long time.

Now stealing a weapon or buying one from an individual……that´s different. No background checks!

Restrictions should be applied to a person not a firearm.

Libs and the Gov´t want to restrict everone´s 2nd amendment rights via licensing, taxing, bureaucracy, ATF rules, manufacturing, sales recordings, limitation on type, how a firearm looks vs how it functions, ridiculous definitions such a "assault", attacks against people and institutions (NRA) fighting to preserve the 2nd amendment, making firearm ownership onerous, barbaric and pugnatious - while praising abortions, denouncing hunting as killing Bambi but still saturating movies and TV horrific and graphic visuals of guns blasting people to smithereens.

Long live the NRA. The NRA and the 2nd amendment are your very best guarantee for liberty.

#6 & 16. In 1963 a commission set up by John Kennedy proposed the deinstatutionalization of mentally Ill. In 1965 Teddy Kennedy sponsored the Immigration Act to change from primarily European to primarily 3rd world immigrants.

Like most of you, I yearn for shorter winters, more shirt-sleeve weather, less lashing from frigid winds. There was growing buzz over the weekend that a bipartisan agreement on gun control — a deal that would expand background checks — could hit the floor as early as this week. However, any deal could be derailed by the looming threat of a Republican filibuster involving Texas Sen. Ted Cruz. Amid all of the very real threats of war and stuff from North Korea, you´d think American intelligence officers want as much video footage of the enemy as possible. Well, here is one video featuring North Korean exercises and Kim Jong-Un holding a gun, and we´ll say this: they certainly get points for presentation. The case of a same-sex Connecticut couple accused of repeatedly raping and abusing two of their nine adopted boys is headed for trial. Married couple George Harasz and Douglas Wirth of Glastonbury were supposed to be sentenced Friday in Hartford Superior Court under a plea deal, but instead withdrew from their agreement with prosecutors. The men had already pleaded no contest in January to one felony count each of risk of injury to a minor — a reduction from even more serious charges related to sexual assault....
