| San Antonio, Texas - The top U.S. military appellate court on Monday ruled that the judge presiding over the case of an Army major charged with a 2009 massacre at Fort Hood, Texas is not impartial and ordered him removed. The court also set aside the order by the judge, Colonel Gregory Gross, that accused gunman Major Nidal Hasan be forcibly shaved. The action by the United States Court of Appeals for the Armed Forces further delays the trial of Hasan, 42, who is charged with 13 counts of premeditated murder after he allegedly opened fire on soldiers and support personnel in a room

So the Appeals Court is saying that Hassan doesn´t have to follow Army regulations so that must mean he is an unlawful enemy combatant is not subuject to the UCMJ. Throw him Gitmo and let him rot there for awhile then execute him.

From my Monday Morning QB perspective it looks like the court fell into the trap of deciding to deal calmly with every detail and any objection. That can lead to infinite delay.
A smart civilian judge will not tolerate it or hesitate. The trial proceeds even if the defendant must be bound and gagged.
A defense can always appeal but seldom can successfully stall.
This case must seem a farce to most world.

He´s not entitled to the appellation of "Major." He long ago rejected his oath and responsibilities and began acting with our enemies.
#2: There are some 2-million-plus uniformed military. They´re not monolithic in their views.
#4: Hasan was hit some number of times, I don´t remember how many, or where. But certainly some blame must adhere to the use of 9mm ["compatible with what the Eunics use" -- whoopee] instead of the magnificent designed-for-the-military John Moses Browning M1911. I wonder to whether they were stuck using hardball, not JHP.

I will say it again, since no one is putting the pieces of this puzzle together on their own.
Obama is CiC. Obama must sign the death certificate. The trial, and death sentence will NEVER conclude during the Obama presidency.
Why? It is illegal for muslims to kill each other, by decree or physical hand, according to Sharia law.
Mark my words, and come back in 4 more years with your outrage when you finally wake up.
The Muslim in Chief will not sign the death certificate. He CAN´T.

Remember, Hasan was on Obama´s presidential transition team for HHS. Watch this guy... I don´t think he´ll be allowed to walk but minimally placed in a comfy place for the rest of his life. FYI... right after the massacre, Hasan said he did it because Obama was taking too long.

In the message he issued along with his budget proposal on Wednesday morning, President Barack Obama said he wants to see 4-year-old children in the United States enrolled in public schools. Obama said America needs to start enrolling 4-year-olds to make sure the children are “better prepared for the demands of the global economy” and to help parents save on "child-care costs."
