Ken Dilanian, a reporter for NBC News, tweeted on Monday that the idea of North Dakota and New York having the same amount of senators "has to change" because of the confirmation of Justice Brett Kavanaugh to the Supreme Court. "It may not happen in our lifetimes, but the idea that North Dakota and New York get the same representation in the Senate has to change," Dilanian tweeted, linking to a Washington Post article about the confirmation of Kavanaugh. Shear stupidity. Each state is given equal representation in the Senate. The House number is based on population. To have both houses based on population gives too much power to the large states like New York and California. There was a reason for making the House and Senate different.

What really needs to happen is the Repeal of the 17th Amendment and make Senators appointed by state legislatures again, and put the states back in charge of their senators and take their control away from the political parties. Congress should enact a provision that ANY school that accepts government funding must have mandatory Civic´s classes ad exams from 5th through 12th years for everyone.Teachers included.

I could have taken this guy down on the facts when I was in 6th grade.

Actually, Ken, the real problem is that politicians like Feinstein and Schumer have disproportionately more power than most other Senators, simply because they come from states that keep making the same mistake over and over by re-electing them. That´s what the House of Representatives does, Ken. They represent. Senators originally were representing their states, until the 17th Amendment. Now no one represents the states (or the people, one could say) in Congress. It´s more of a party thing.

Having more senators is a bad idea, Ken. We´ve got enough pompous jackasses running around Washington. The House is based on population. When did it become popular to say "we have more people. Therefor we should rule over you?"

They all missed a fundamental point. There is no constitutional way to change equal representation of the states in the Senate -- except with the consent of the affected states. The framers created two restrictions on the power to change the Constitution: 1) the slave trade was protected through 1808 and 2) equal state representation in the Senate could not be undone without consent. See the last line of Article Five:

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.

There will never be a change in the number of Senators allocated to each State as the smaller States are not going to go along with any constitutional amendment that will diminish their political power in Congress.

Two bodies--the House with short terms of office directly representing the people accounting for how many Electoral College voters

With thanks to #37, both writers need to go back to school. In the "Great Compromise", each State would have 2 Senators, appointed by their respective legislatures, to equally represent the the interests of the States in Congress. Representatives were apportioned among the States by population, as they represent the interests of the people in Congress.

The enactment of the 17th Amendment took away the representation of the States and turned the Senate into an "at-large" House of Representatives. The 17th Amendment needs to be repealed to permit the States their proper representation.

When amending the Constitution requires 3/4 of the state legislature and 2/3 of Congress, it is no wonder that only 27 out of 11,000 attempts have succeeded. There are not enough big states to have a shot at taking away the power of their siblings.
