Motel 6 was sued on Wednesday by Washington state’s attorney general, who accused the discount hotel chain of illegally providing guest lists to U.S. immigration authorities, knowing of their interest in people with “Latino-sounding” names. Attorney General Bob Ferguson said six Motel 6 locations in Washington provided names, birth dates, license plates and other personal information belonging to at least 9,151 guests to U.S. Immigration and Customs Enforcement agents from June 2015 to May 2017. There´s something wrong when a company is sued by a state for following federal law. Like activist judges, there may bea real storm brewing over the separation of powers designed by our Constitution.

Motel 6 should do all it can to move this to Federal court. Motel 6 has no chance in state court and since abiding by Federal law might be a significant factor in the case, it would be interesting to see how the discrimination law fares against Federal law.

The State of Washington does not have legal authority to interfere with federal law enforcement requests to businesses or any witnesses or people who may be the custodians of evidence being sought for federal law enforcement purposes. When a state court attempts to do that, the legal case is transferred to the federal courts where it is dismissed.

A person’s national origin has nothing to do with immigration law enforcement. What is important is a person’s alienage and if the person is deportable under provisions of the immigration laws.

It certainly seems like SAG Ferguson has grabbed the tiger by the tail on this one. The article is too slim on facts to get a real feel for it but if his state law stepped on the toes of the federal laws, that is, it is preempted by federal law, his state law is void, I would think.
I would not think that Ferguson is completely mad so he must think he has found a way around it. In any event, to me, the wall Mr. Ferguson is about to run into is that both the federal courts and the state courts are equally obligated to uphold the laws of the land - that would be the Constitution which grants preemption rights to the feds.

If they were under a court order or had a reasonable suspicion about skulduggery afoot, I can see it. If they are just handing them over to be handing them over, I do have a problem with that. I will not stay at such a place. Next thing you know they might want to report people with redneck state license plates or carrying cases that might hold rifles.
Rent your room, collect your money and if the guest isnt hurting anything, leave them be.

Who are they suing? About 2/3rd of Motel 6 properties are owned by franchisees. Independent businessmen and women, often families.

As usual, go after the little guy with limited resources with the heavy handed power of the state.
